PAKD Tote Rental Agreement

A.M. Collective LLC, DBA "PAKD" ("PAKD," "we," "us")
Serving Fresno & Clovis, CA

This Rental Agreement ("Agreement") is entered into between PAKD and the customer identified at checkout ("Customer," "you"), and governs the rental of reusable moving totes ("Totes") described in your order confirmation.

By checking the box and/or typing your name at checkout, you agree to be bound by this Agreement in full.

1. Rental Term

Your rental begins on the pickup or delivery date selected at checkout and ends on the return or pickup date shown on your order confirmation ("Rental Period"). The number of Totes and package tier rented are as stated on your order confirmation.

2. Fees

You agree to pay the package price, and delivery fee if applicable, as confirmed with PAKD when your booking request is approved. Payment is arranged directly between Customer and PAKD at that time, including any charges under Sections 4 and 5 below.

3. Use of Totes

Totes must be used only for their intended purpose — packing and transporting household or business goods. Totes must not be overloaded beyond reasonable capacity, exposed to open flame or extreme heat, or used to transport hazardous materials. Customer is responsible for Totes from the time of pickup/delivery until they are returned to PAKD or collected by PAKD.

4. Damage & Loss

Totes remain the property of PAKD at all times. Customer is financially responsible for any Tote that is damaged, lost, or not returned, according to the following schedule:

PAKD will inspect returned Totes and notify Customer of any charges under this section within 3 business days of return, with photos where applicable. Charges will be applied to the payment method on file.

5. Late Returns

If Totes are not returned or made available for pickup by the end of the Rental Period, a late fee of $10 per day applies until the Totes are returned or PAKD is notified and a new return date is confirmed. If Totes remain outstanding more than 14 days past the end of the Rental Period without contact from Customer, PAKD may treat the Totes as a total loss and charge the applicable fee under Section 4.

At the time of return or pickup, PAKD will count the Totes on-site with Customer present. The count confirmed at that time is final and binding. PAKD is not responsible for verifying counts after Totes have left the pickup location.

6. Delivery & Pickup

If delivery was selected, PAKD will deliver Totes to the address provided at checkout. Someone 18 years or older must be available to receive delivery and, at the end of the rental, to release Totes for pickup. Delivery is limited to addresses within PAKD's standard service radius from Clovis, CA; deliveries outside this radius require prior arrangement and may incur additional fees.

7. Limitation of Liability

PAKD is not responsible for the contents packed inside Totes, including damage, loss, or theft of Customer's personal property. Customer is solely responsible for insuring the value of items packed in the Totes if desired. PAKD's total liability under this Agreement, for any reason, will not exceed the total amount paid by Customer for the rental.

8. Indemnification

Customer agrees to indemnify and hold PAKD harmless from any claims, damages, or injuries arising from Customer's use, misuse, or handling of the Totes, except where caused by PAKD's own negligence.

9. Electronic Signature & Consent

Customer consents to conduct this transaction electronically. Checking the agreement box and typing your full name at checkout constitutes your legally binding signature under the U.S. ESIGN Act and California's Uniform Electronic Transactions Act, with the same effect as a handwritten signature. A copy of this signed Agreement, including the timestamp of your acceptance, will be emailed to the address provided at checkout.

10. Governing Law & Disputes

This Agreement is governed by the laws of the State of California. Any disputes arising under this Agreement will be resolved in the courts of Fresno County, California, or through small claims court where applicable.

11. Entire Agreement

This Agreement, together with your order confirmation, constitutes the entire agreement between Customer and PAKD regarding the rental of Totes, and supersedes any prior verbal or written agreements.
